RENTAL CUSTOMER DISCLOSURE
The common areas of the Madeira Vista Condominium Association are controlled and managed exclusively by the Associations Board of Directors. Individual unit owners do not have the authority to control, manage or make decisions regarding the common areas.
The tenant’s rental agreement is soley with the individual unit owner and applies only to the interior of the rented unit. The association is not a party to the rental agreement.
All water/sewer and cable services are provided to the unit owners by the Association.
Common area includes but are not limited to trash enclosures, stairwells, elevators, recreational patios, parking areas, pool facilities, and hallways.
Tenants are required to comply with all provisions of the Declaration of Condominium Articles of Incorporation, Bylaws, and duly adopted rules and regulations of the Association, as amended from time to time. The Association retains exclusive authority to regulate, restrict, suspend, modify, or control the use of common elements in accordance with Chapter 718 Florida Statutes, and the Associations governing documents.
Assumption of Risk and Waiver. The tenant acknowledges the use of the common elements involves risk, including the risk of personal injury, property damage, or loss. The tenant knowingly and voluntarily assumes all such risks arising from and related to occupancy of the unit and use of the common elements. To the fullest extent permitted by Florida Law, the tenant waives and releases any claims against the association arising from the tenant’s use of common elements, except to the extent caused by the Associations gross negligence or willful misconduct, as determined by the court of competent jurisdiction.
Use of the common elements is at the tenants’ own risk and is always subject to lawful regulation by the Association.
